2. Rendering service

The Service is an automatized system allowing anyone to externalize computation tasks that are necessary to process a rendering project on Qarnot computing’s platform.

A Project is composed of a set of files that are necessary to the rendering process.

Qarnot computing can initiate the rendering service only if the Project’s set of files has been uploaded on the platform.

Qarnot computing may delete a Project’s files, as well as the rendering outputs, 24 hours after the end of the last rendering job performed on this Project.

3. User Account, Sign Up and Termination

To access the Service, the Client must create a User Account.

The Client has the responsibility to provide full and correct information, as requested by the registration form, and to update them in case of a change before to use the Service.

The Client is entirely responsible for any activity related to the User Account and committed to secure the access to its corresponding personal password.

In case the information provided is false, incomplete or obsolete, Qarnot computing may suspend the access of the Client to the rendering Service immediately and without any compensation. Qarnot computing reserves the right to refuse the access to the rendering Service to people communicating information that Qarnot computing would consider incompatible with the good management of the Service, or against the law.

Qarnot computing reserves the right to block the access of a Client to the Service if it judges the behaviour of the Client inappropriate. The consequence would be the deletion of both the User Account and the data associated with the Client.

At any time, the Client can terminate his account with a written notification to Qarnot computing.

In case of termination of the User Account, all the data transmitted by the Client will be deleted of Qarnot computing’s servers.

4. Pricing and Credits System

The service is based on the purchase of Credits by the Client. According to the context of use of the Service, the Service can lead to Credits consumption.

Prices and discounts applied by Qarnot computing in general, but also to the rendering Service, are available for consultation on the web site.

At any time, Qarnot computing reserves the right to modify its pricing policy and rates, and/or to establish any new contribution applicable to the Service.

Qarnot computing will proceed to no refund, in whole or in part, in case of termination of the rendering Service or in case the Client does not use the rendering Service.

Qarnot computing reserves the right to define a minimum threshold of Credits to launch a rendering job, and to interrupt a rendering job if this minimum threshold is reached.

5. Responsibility of Qarnot computing

Qarnot computing offers no guarantee as for the reliability, the quality, the relevance or the availability of the proposed Service. The Client recognizes and accepts that the use of the Service is made at his own costs and risks, and that the Service is offered without warranties of any kind.

Qarnot computing is committed to do its best to assure the quality of the service and its regularity.

If necessary, Qarnot computing has the possibility to interrupt the access to the web site in order to carry a technical intervention or for any maintenance operation.

Qarnot computing cannot, in any circumstances, be considered responsible for the direct or indirect damages incurred by the Client including, without limitations, losses of profits.

In any case, the Client understands and accepts that the responsibility of Qarnot computing remains limited to the sums actually paid by the Client and received by Qarnot computing. Beyond these sums, the Client waives the right to institute proceedings against the company Qarnot computing and its agents, executives, assistants and employees.

Qarnot computing cannot be held responsible if the non-fulfilment or defective execution of the Service is imputable either to the Client or to a case of force majeure.

6. Responsibility of the Client

The Client acts as an independent entity. As a consequence, he accepts the risks and dangers of his activity on the Service. The Client is solely responsible for the content of the information transmitted, spread or collected, as well as for their exploitation and for their update. The Client is also responsible for all the files.

The Client is particularly committed to the respect of eventual third-party rights, most importantly rights of the personality and intellectual property rights such as copyrights, patents or trademarks.

Qarnot computing cannot be held responsible for the contents of the information transmitted, spread or collected, for their exploitation and for their update, as well as for any files, in particular mailing lists, in any case.

Qarnot computing warns the Client on the legal consequences, which could result from illicit activities on the platform. This is also true if the Client turns out to be using hostile computing techniques. Such behaviour on behalf of the Client will entail the immediate termination of his User Account without notice. If it happens, the Client cannot pretend to a refund of the sums already paid for the Service.

7. Intellectual Property, Security and Data Protection

The Client allows Qarnot computing to access the information transmitted for maintenance or improvement of the Service.

Data circulating over the Internet network can be hijacked, lost or hacked. Therefore, the Client communicates confidential or important data at his own risks.

Qarnot computing commits, within the framework of its duty, to do everything in its power to insure the safety and the privacy of the data transmitted by the Client. Qarnot computing commits not to exploit or transmit to a third party the data passed on by the Customer without his explicit agreement.
